Terms & Conditions of Entry
Welcome to The Rusty Nail. We want everyone to enjoy their time with us in a safe, respectful and welcoming environment. By entering our venue, making a booking or attending a function, you agree to the following Terms & Conditions.
1. Responsible Service of Alcohol
The Rusty Nail operates in accordance with Queensland liquor licensing legislation and Responsible Service of Alcohol (RSA) requirements.
All patrons must comply with applicable liquor licensing requirements and lawful directions given by our staff.
Alcohol will not be served to anyone under the age of 18 or to anyone who is unduly intoxicated.
Patrons who are intoxicated, disorderly, aggressive or behaving in an unsafe manner may be refused service and/or asked to leave.
Valid identification must be presented upon request.
Patrons must not purchase or supply alcohol for anyone under the age of 18.
Management reserves the right to manage patron numbers, restrict entry and refuse service in accordance with applicable laws and venue requirements.
2. Underage Patrons
Anyone under the age of 18 must be accompanied and supervised by a responsible adult at all times while on the premises.
Underage patrons must comply with applicable liquor licensing requirements. Access to certain areas or events may be restricted in accordance with our licence conditions.
3. Hospitality Service Fee
At The Rusty Nail, we do not charge a credit card surcharge. We do, however, have a flat 2% hospitality service fee.
This fee helps cover our digital ordering systems, table technology and platform operations. It applies to all transactions at checkout.
4. Outside Food and Beverages
Outside food and beverages are not permitted within The Rusty Nail unless expressly approved by management in advance.
Any outside food or drinks brought onto the premises must be disposed of or securely sealed and taken away for consumption after leaving our venue.
Exceptions may be considered by management for approved functions, special dietary requirements or other circumstances agreed upon in advance.
5. Smoking and Vaping
Smoking and vaping are not permitted anywhere on The Rusty Nail premises, including the footpath dining area.
Patrons wishing to smoke or vape must leave the premises and comply with all applicable Queensland smoke-free laws and designated smoking restrictions.
6. Functions, Private Events and Venue Hire
All function and private event bookings, including bookings of designated areas or the entire venue, are subject to the following conditions:
A $250 non-refundable booking fee must be paid to secure the booking.
The $250 booking fee may be applied towards preordered food or used as a bar tab on the night of the event. It is not an additional fee on top of these purchases.
The agreed bar tab, food tab, minimum spend and other function arrangements must be discussed and confirmed with management in advance.
The term “Minimum Spend” relates to a non-refundable spend that covers costs for missed trade during your closed off event in part or entirety of the venue. It represents the trade we give up during the booked time and is a necessity to dedicate our venue and staff to your event and provide the best experience possible for your party. This “minimum spend” varies in amount at different times of the week and year and will be disclosed during the booking process.
The booking fee and agreed food and bar tab arrangements must be paid or finalised no later than five business days before the scheduled event, in accordance with the arrangements agreed with management.
Any changes to guest numbers, event timings, food requirements or spending arrangements must be communicated to management as early as possible.
Any function which leaves decorations behind or has damaged property beyond simple repair, the booking organiser will be charged a cleaning fee of $350, or replace the damaged goods.
Additional purchases or agreed costs incurred during the event remain the responsibility of the booking organiser.
The booking organiser is responsible for ensuring their guests comply with these Terms & Conditions and follow staff directions.
Cancellation, rescheduling and any applicable refund arrangements for other payments will be handled in accordance with the booking agreement and applicable Australian Consumer Law.
Please speak with management before your event if you have any questions about your booking arrangements.
7. Cellar Access and Safety
The Rusty Nail cellar may be used for private bookings or accessed by general patrons when it is not reserved for an event.
The cellar has a lower-than-standard ceiling height, creating a risk of accidentally striking your head. Patrons entering the cellar acknowledge the reduced ceiling clearance and must take care when moving through the space.
The cellar has one exit, which leads directly to the outside laneway. Patrons should familiarise themselves with this exit upon entering and keep access to it clear at all times.
Please take care when moving around the cellar, particularly when the area is busy, and follow any safety signage or directions provided by staff.
Children must be supervised by a responsible adult at all times. Management may restrict access to the cellar where necessary for safety, capacity management or private event arrangements.
8. Dietary Requirements and Food Allergies
We offer menu items that may be suitable for people seeking gluten-free, dairy-free or nut-free options. However, we cannot guarantee that any food or beverage is completely free from allergens or cross-contamination.
Our food and drinks may be prepared, stored or handled in environments where allergens are present.
Please advise our staff of any allergies or dietary requirements before ordering.
Customers with severe allergies should speak directly with management before placing an order.
While we will make reasonable efforts to provide accurate ingredient information and accommodate dietary requests where possible, we cannot guarantee the absence of allergens or cross-contamination.
If you have a serious food allergy, please contact us before your visit so we can discuss the available options.
9. Respectful Behaviour and Staff Conduct
We are committed to providing a welcoming environment for our patrons and our team.
We encourage constructive feedback and appreciate the opportunity to resolve concerns. However, abusive, threatening, discriminatory, aggressive or deliberately disrespectful behaviour towards our staff or other patrons will not be tolerated.
Patrons must treat all staff, contractors and fellow guests with courtesy and respect.
Management reserves the right to refuse service or ask patrons to leave where behaviour is inappropriate, unsafe or inconsistent with these Terms & Conditions.
10. Venue Safety, Property and Personal Belongings
Patrons must act responsibly and take reasonable care of the venue, its furnishings, equipment and facilities.
Deliberate or negligent damage to venue property may result in the responsible person being held liable for reasonable repair or replacement costs, subject to applicable law.
Fighting, harassment, vandalism, threatening behaviour and other unlawful conduct are prohibited.
Patrons must follow safety signage and reasonable instructions from staff.
Personal belongings remain the responsibility of their owner. The Rusty Nail is not responsible for lost, stolen or unattended property, except to the extent required by law.
Hazards, injuries, accidents or safety concerns should be reported to a staff member immediately.
11. Photography and Filming
Photography and filming may take place at The Rusty Nail for promotional or event purposes. Please speak with management if you have concerns about being photographed or filmed upon arrival to the venue.
Private event organisers are responsible for communicating any specific photography or filming arrangements to their guests in advance. Personal information and identifiable images will be handled in accordance with applicable privacy laws.
12. Right of Entry and Refusal of Service
The Rusty Nail reserves the right to refuse entry, refuse service or require a patron to leave where permitted by law, including where a person is intoxicated, disorderly, aggressive, behaving unsafely or failing to comply with venue policies or lawful staff directions.
All decisions will be made in accordance with applicable Queensland legislation, liquor licensing requirements and anti-discrimination laws.
13. Acceptance of These Terms
By entering The Rusty Nail, making a reservation or attending a function, patrons are expected to comply with these Terms & Conditions.
These Terms & Conditions may be updated from time to time. The current version published by The Rusty Nail will apply, subject to applicable law and any specific booking agreement.
